Introduction
While interpretation of regulations is the preserve of the Courts, the Scottish Ministers have the power to give a view on the extent to which a proposed building or construction complies with the regulations. Most of the technical information related to the standards in the regulations is contained in the Technical Handbooks and other technical guidance documents issued by the Ministers.
Where the owner or the verifier considers there is doubt about the extent to which a building or design meets the building standards, a joint referral could be made to the SBS for their view on compliance. A fee may be payable, related to the cost of the building warrant, please see Guide on Fees.
A verifier must have regard to any view expressed when determining the proposals in a warrant application.
Verifiers should note that a formal view will not be given on matters certified by an Approved Certifier of Design.
